Terms of Service & Usage Agreement

1. Acceptance of Terms

By accessing the GIST Awareness library, downloading lesson plans, or utilizing our instructor guides, you agree to be bound by these Terms of Service. These materials are intended for professional use by Fleet Safety Managers, Trainers, and authorized personnel.

2. Educational Nature & Liability Disclaimer

PLEASE READ CAREFULLY.

GIST Awareness provides training materials for educational purposes only. While we strive to align our content with FMCSA and OSHA regulations:

  • Not Legal Advice: Our content does not constitute legal counsel. Fleet regulations vary by state, cargo type (HazMat), and vehicle weight. You are responsible for verifying compliance with your local jurisdiction.
  • No Guarantee of Safety: Completion of these training modules does not guarantee that a driver will not be involved in an accident. GIST Awareness is not liable for any accidents, citations, or damages incurred by drivers who have viewed our content.
  • Employer Responsibility: The Carrier (Employer) retains sole responsibility for the supervision, hiring, and retention of its drivers.

3. Intellectual Property Rights

All content, including lesson plan scripts, printable checklists, diagrams, and quizzes, is the intellectual property of GIST Awareness.

Permitted Use: You may print and distribute materials physically to drivers within your own organization.
Prohibited Use: You may not resell, repackage, or publicly post these materials on the open web. You may not use these materials to train drivers from other companies for a fee (i.e., you cannot use our library to run a commercial driving school) without an Enterprise Reseller License.

4. Account Security

You are responsible for maintaining the confidentiality of your login credentials. Sharing a single “Admin” login among multiple trainers violates our seat-license policy. Each Instructor must have unique credentials to ensure accurate audit trails of who conducted training sessions.

5. Subscription & Cancellation

Subscriptions are billed monthly or annually. You may cancel at any time via the Admin Dashboard. Access to the library continues until the end of the current billing cycle. There are no partial refunds for mid-month cancellations.

6. Governing Law

These terms shall be governed by the laws of the State of [State], without regard to its conflict of law provisions. Any disputes arising from the use of this training material shall be resolved through binding arbitration.
